Terms and Conditions

These Terms and Conditions (“Terms”) govern your ( or “you”) access to and use of Breeze Job Finder, the Breeze Job Assistant Chrome Extension, and all related services (the “Services”) provided by Breeze Unlimited or any of its affiliates or officers (“we”, “us”, or “our”). By using the Services, you agree to be bound by these Terms.
1. Eligibility and Account Responsibility
You must be at least 16 years old to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. By agreeing to use our Services, you also agree to provide accurate and up-to-date information. You will indemnify us for any inaccurate, fraudulent, or misrepresented information that you have provided.
2. Use of AI Features
Some Services include AI-powered generation and extraction tools. These features may require sending your data (including resume content, job listings, and application materials) to third-party AI providers to generate or extract relevant information. By using these features, you consent to this data being shared with such third-party services for processing.
3. User Content
You retain ownership of any resumes, cover letters, job applications, or other content (“User Content”) you upload or generate using the Services. You grant us a limited, non-exclusive license to use that content solely for the purpose of providing and improving the Services.
4. Content Generated by AI
You understand and agree that we are not responsible or liable for any content generated by AI features within the Services. AI-generated content may be inaccurate, inappropriate, or unfit for your intended use. You are solely responsible for reviewing and verifying any such content before relying on it.
5. Analytics and Tracking
We use analytics tools, including, but not limited to, Google Analytics and Microsoft Clarity, to understand how our Services are used and to improve user experience. These tools may collect data such as browser type, device information, pages visited, and time spent on pages. By using the Services, you consent to the collection and use of this information for analytics purposes.
6. Account Suspension or Termination
We reserve the right to suspend or permanently terminate or delete any user account at our sole discretion, especially in cases of abuse, violation of these Terms, or behavior that may harm other users or our Services. We may also restrict access to specific features if misuse is detected in our reasonable discretion.
7. Prohibited Use
You agree not to:
• Use the Services for illegal or unauthorized purposes
• Reverse engineer or attempt to extract source code from the software
• Use automated systems to access or interact with the Services without our written permission
• Upload content that infringes on any intellectual property rights or contains misleading, fraudulent, or harmful information
8. Intellectual Property
All software, branding, and content created by or for Breeze Unlimited (excluding User Content and AI-generated content) is our property or licensed to us and may not be copied, altered, or distributed without our permission.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.” We make no warranties regarding the accuracy, reliability, or availability of the Services or any content generated by AI tools or otherwise.
10. Limitation of Liability
To the maximum extent permitted by law, Breeze Unlimited shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Services, including reliance on AI-generated content or loss of user data. Our maximum liability for any claim under the Terms shall not exceed the cost paid for the Services by you.
11. Changes to Services or Terms
We may update or modify the Services or these Terms at any time, with or without notification to you. We will notify users of major changes by posting an update or sending an email. Continued use of the Services after any changes means you accept the updated Terms.
12. Governing Law and Mandatory Arbitration
These Terms are governed by the laws of Arizona, without regard to its conflict of law principles. Except as otherwise specified below, all actions, disputes, claims, and controversies under common law, statutory law, or in equity of any type or nature whatsoever, whether arising before or after the date of acceptance of these Terms, and whether directly or indirectly relating to: (a) these Terms, or the breach, invalidity, or termination hereof; (b) any use of the Services by you; (c) any third-party or AI-related service in relation to the Services, and/or (d) any other relationship, transaction, or dealing between the parties (collectively the “Disputes”), will be subject to and resolved by binding arbitration pursuant to the American Arbitration Association. Any award or order rendered by the arbitrator may be confirmed as a judgment or order in any state or federal court of competent jurisdiction, which includes within the federal judicial district of the residence of the party against whom such award or order was entered. If for any reason, this arbitration clause is found to be unenforceable, or if such arbitration provides for further dispute resolution, then any further legal disputes must be resolved in the appropriate courts located in Phoenix, Arizona. To the extent applicable and permissible by law, both parties WAIVE ANY RIGHT TO A JURY TRIAL under these Terms.
